Welcome to FreelanceMantra.com (“Website”, “Platform”, “Company”, “we”, “our”, or “us”). Freelance Mantra Pvt. Ltd., headquartered in Delhi, India, operates this freelancing marketplace to connect clients and freelancers.

By registering, accessing, or using our Platform, you (“User”, “Freelancer”, or “Client/Employer”) agree to be bound by these Terms of Service, our Privacy Policy, and any other applicable policies. If you do not agree, please do not use the Website.

1. Definitions

  • Freelancer: An independent professional offering services through the Platform.
  • Client/Employer: A person or entity posting projects/jobs and hiring freelancers.
  • User: Any person visiting, registering, or using the Website.
  • Project/Job: A task, gig, or service posted by a Client.
  • Milestone/Payment: Agreed compensation between Freelancer and Client for work completed.

2. Eligibility

  • Users must be at least 18 years of age and capable of forming legally binding contracts.
  • Businesses/entities must be legally registered and authorized to operate in their jurisdiction.
  • By using the Platform, you confirm that all information provided is accurate and truthful.

3. Account Registration

  • Users must create an account with valid details (name, email, phone, payment info, etc.).
  • You are responsible for safeguarding your account credentials.
  • We reserve the right to suspend or terminate accounts that provide false, incomplete, or fraudulent information.

4. Platform Role & Disclaimer

  • FreelanceMantra.com is a neutral online marketplace.
  • We do not employ Freelancers nor guarantee the quality of work delivered.
  • All agreements are directly between Freelancer and Client.
  • The Company is not liable for disputes, delays, or damages arising from projects.

5. User Responsibilities

(a) For Freelancers

  • Deliver services as agreed upon in the project scope.
  • Maintain professionalism, originality, and timely delivery.
  • Avoid plagiarism, fraudulent activities, or illegal work.
  • Respect client confidentiality and intellectual property rights.

(b) For Clients/Employers

  • Provide accurate project details, deadlines, and fair payment.
  • Release payments upon satisfactory completion of milestones.
  • Avoid discrimination, exploitation, or unreasonable demands.
  • Use the platform only for legitimate business purposes.

6. Payments & Fees

  • Payments are processed through secure third-party payment gateways (UPI, bank transfer, cards, wallets, etc.).
  • Freelancers agree to pay a platform service fee (percentage/flat fee, as applicable) deducted from project earnings.
  • Clients may also be charged a nominal fee for posting projects or transactions.
  • We do not handle cash transactions.

7. Refunds, Disputes & Resolution

  • Refunds (if applicable) are subject to project terms and our Refund Policy.
  • In case of disputes, both parties must first attempt resolution through the platform’s dispute resolution system.
  • FreelanceMantra reserves the right to mediate but does not guarantee outcomes.
  • Final responsibility rests with the Freelancer and Client.

8. Prohibited Activities

Users agree not to:

  • Violate any laws, regulations, or third-party rights.
  • Post misleading or offensive content.
  • Circumvent the Platform by making off-platform payments or deals.
  • Spread malware, spam, or fraudulent schemes.
  • Create multiple fake accounts.

9. Intellectual Property

  • Freelancers retain rights to their work until payment is made.
  • Upon full payment, Clients obtain rights to the work unless otherwise agreed in writing.
  • Users must respect copyrights, trademarks, and proprietary rights of others.

10. Limitation of Liability

  • FreelanceMantra.com is not liable for:
    • Project quality, deadlines, or outcomes.
    • Loss of data, revenue, or reputation.
    • Technical issues, downtime, or unauthorized account access.
  • Our total liability, if any, shall not exceed the fees paid to us for the specific transaction in dispute.

11. Termination

  • We reserve the right to suspend/terminate accounts that:
    • Violate these Terms or applicable laws.
    • Engage in fraud, harassment, or abuse.
  • Users may deactivate accounts anytime by contacting support.

12. Governing Law & Jurisdiction

  • These Terms are governed by the laws of India.
  • Jurisdiction: Courts of Delhi, India.

13. Amendments

We may update these Terms from time to time. Users will be notified via website updates or email. Continued use of the Platform constitutes acceptance of changes.
